PROBATE
After a client passes, my role is to “hold a family’s hand” and walk them through the process. Knowledge is power, and understanding brings certainty and comfort. We help the family complete the Petition to Probate in Solemn Form or to Administer an Estate (for a person dying without a Will) and file it with the Probate Court. I go over to the Courthouse with the named Executor or Administrator for the hearing (meeting) with the Probate Court Judge to take his or her oath of office and receive the Court Order and Letters Testamentary or of Administration.
Families unnecessarily stress out when someone dies without a Will, because Georgia law mandates that a surviving spouse receive only a child’s portion of the deceased’s estate. What if the surviving spouse’s children want to sell their portion of their mom or dad’s home? To avoid intestacy, one must have a Will or Trust.
Once the Probate Judge appoints an Executor or Administrator, my legal experience is a big help. Typically, I: (i) help the family work together; (ii) run the required notice in the newspaper; (iii) draft an Executor or Administrator’s Deed; (iv) identify title issues; (v) transition the decedent’s business, corporation or limited liability company; (vi) and help work many other complex issues.
